Rights of Foreign Nationals Under Indian Law: What You Need to Know
India provides legal protection to all individuals within its territory, including foreign nationals. Whether you're in India for travel, work, study, or residence, you are entitled to certain rights under the Indian legal framework.
1. Constitutional Protection
Foreign nationals in India enjoy fundamental rights under Part III of the Indian Constitution, such as:
- Right to equality before the law (Article 14)
- Protection of life and personal liberty (Article 21)
- Protection against arbitrary arrest and detention
2. Access to Indian Courts
Foreign nationals have the right to file petitions, civil suits, or criminal complaints in Indian courts. They can also be represented by legal counsel and seek protection or remedies under Indian law.
3. Police Protection and FIR Rights
Any foreigner facing harassment, fraud, or crime in India can approach the police and file an FIR (First Information Report). You cannot be denied protection on the basis of your nationality.
