Legal Grounds for Permanent Cancellation
Under the Motor Vehicles Act, 1988, a driving license can be permanently revoked for reasons such as:
- Habitual Drunken Driving (Section 185)
- Rash or Negligent Driving causing death (Section 279/304A IPC)
- Driving Without License repeatedly or fraudulently obtaining one
- Using a vehicle for illegal activities
- Endangering public safety through repeated violations
When such offences are proven, the RTO can initiate license cancellation procedures.
Cancellation Process & RTO Authority
The Regional Transport Office (RTO) is the authority empowered to cancel or suspend licenses. Here’s the general process:
- The RTO issues a show-cause notice to the license holder.
- A hearing is scheduled where the driver may present their case.
- If grounds are sufficient, the license is either suspended temporarily or cancelled permanently.
Once cancelled, it’s not easy to get it reinstated unless a fresh application is made after a cooling-off period, and often, re-tests are required.
